1. Acceptance of Terms

By downloading, installing, accessing, or using ToneSeed Fretboard Trainer (the "App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

2. Description of Service

ToneSeed Fretboard Trainer is a music practice application for guitar, bass, ukulele, mandolin, and other fretted instruments. The App helps users learn notes, intervals, chords, scales, tuning, and string bends through fretboard drills, mic-based pitch detection, a chromatic tuner, chord tools, a scale guide, progress tracking, and customizable instrument presets.

3. Accounts

You may use the App without creating an account. If you choose to create an account via email, Google Sign-In, or Apple Sign-In, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to provide accurate information when creating an account and to notify us promptly of any unauthorized use.

4. Subscriptions and Lifetime Access

ToneSeed Fretboard Trainer offers auto-renewable subscription plans and may offer a one-time lifetime purchase (collectively, "ToneSeed Fretboard Pro") that unlock premium features, including interval training.

A lifetime purchase unlocks the eligible Pro features of the App without a recurring subscription fee. "Lifetime" means the useful life of the App as we make it available and support it. It does not mean your lifetime, our lifetime, or a commitment that any online service, backend system, account sync, backup, support channel, future app version, future feature, or separate product will remain available indefinitely.

By purchasing a subscription or lifetime access, you agree to the following:

Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
For subscriptions, your account will be charged for renewal within 24 hours prior to the end of the current period at the same price, unless the store page or subscription settings show a different renewal price.
You can manage and cancel your subscription at any time through your device's subscription settings, the App Store, or Google Play.
Lifetime purchases do not renew and do not need to be canceled. They may be restored through the App Store or Google Play while the App and the applicable store services support purchase restoration.
Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

5. Free Trial

We may offer a free trial period for Pro features. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged the applicable subscription fee by Apple or Google.

6. Refunds

Refunds are handled by Apple or Google in accordance with their respective refund policies. We do not process refunds directly.

7. Online Services, Sync, and Offline Use

The App is designed so many features can work offline on your device. Some features, however, may require online services, including account creation, account sign-in, cloud sync, backup, account recovery, purchase validation, purchase restoration, remote configuration, customer support, analytics, diagnostics, or other server-connected functionality.

Online services are provided on an "as available" basis. We may modify, suspend, limit, or discontinue online services or backend infrastructure at any time, including services used for account sync and backup. If an online service is changed or discontinued, locally available App features may continue to work on your device, but synced data, cross-device access, account recovery, purchase restoration, or other online features may be unavailable or limited.

You are responsible for maintaining access to your device, app store account, and any local data you want to keep. We do not guarantee that synced data, backups, server-side entitlements, or online services will be available indefinitely.

8. User Content and Data

You may create or save content within the App, such as custom instrument presets, custom tunings, chord favorites, and practice results ("User Content"). You retain ownership of your User Content. By using account sync, you grant us a limited license to store and transmit your User Content solely for the purpose of providing sync, backup, account recovery, and related App functionality.

9. Microphone-Based Features

The App may use your device microphone for tuner, note detection, interval training, and bend training features. These tools are provided for practice and educational purposes. They may be affected by device hardware, room noise, instrument setup, and playing technique. You are responsible for using appropriate hearing protection, volume levels, and instrument care.

10. User Conduct

You agree not to:

Reverse engineer, decompile, or disassemble the App
Reproduce, distribute, or create derivative works from the App
Use the App for any unlawful purpose
Attempt to circumvent any subscription or access restrictions
Interfere with or disrupt the integrity of the App or its servers
Share your account credentials with others or allow multiple people to use a single account

11. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, audio, sound resources, chord data, scale data, exercises, and software, are the exclusive property of ToneSeed or its licensors and are protected by copyright, trademark, and other intellectual property laws.

12. Termination

We reserve the right to suspend or terminate your access to the App at our discretion if you violate these Terms. You may delete your account at any time from within the App settings. Upon account deletion, your synced data will be permanently erased in accordance with our Privacy Policy. Termination does not affect any active subscriptions; you must cancel your subscription separately through your device's subscription settings, the App Store, or Google Play.

13. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, accurate in every pitch-detection scenario, or free of harmful components. We also do not guarantee that online services, backend systems, account sync, backup, purchase restoration, or server-connected features will remain available indefinitely.

14. Limitation of Liability

To the maximum extent permitted by law, ToneSeed shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including loss of data, loss of access to online services, inability to sync, inability to restore purchases, or interruption of server-connected features.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Changes to Terms

We reserve the right to modify these Terms of Use at any time. We will notify you of changes by posting the updated terms on this page. Your continued use of the App after changes constitutes acceptance of the revised terms.
